App ProtAct17 - Privacy Policy

1. Introduction

The App ProtAct17 (the "App") is provided by BASF SE, Carl-Bosch-Str. 38, 67056 Ludwigshafen ("BASF", "we" or "us"), which  is responsible for the processing of your personal data in accordance with the General Data Protection Regulation ("GDPR") ("Controller").  

With this app, we aim to  

provide children and adolescents with a playful approach to the complex topic of sustainability and the 17 sustainability goals of the United Nations.  

ProtAct17 imparts knowledge in an age-appropriate and interactive way, arouses curiosity and the spirit of research through virtual and real experiments, addresses current and future challenges for the environment, economy and society and shows their own – albeit small – possibilities for action. Inspiring and empowering students to protect the environment (Protect) and to take action in line with the 17 sustainability goals of the United Nations (Act) – this is the idea behind the app.

When you use the app, we process personal data about you. Personal data is any information relating to an identified or identifiable natural person. With this privacy policy, we inform you about which of your personal data we process and how we process it. 

You can access this privacy policy at any time via the menu item Privacy Policy within the app.

 

2. Information on the processing of your personal data

2.1 Personal data processed by downloading the app ProtAct17

When downloading the app ProtAct17, certain information is transmitted to the selected app store, in particular user name, e-mail address, customer number, payment information and device code. This data is processed exclusively by the respective app store and is beyond our control. 

2.2 Personal data automatically processed during the use of the app ProtAct17

As part of your use of the app, we automatically collect certain data that is necessary for the use of the appsuch as score,  repetitions of exercises as well as high scores in time, points and improvements.  This allows the app to remember the progress of the exercises and thus make it possible for the exercises to be completed over several sessions. The data is stored on the end device and is not transmitted. This is technically necessary for the operation of the app. The legal basis for this data processing is § 25 para. 2 no. 2 TTDSG.

 

3. Duration of data storage

With the exception of the score (cf. No. 2.2) the use of the app is  possible without personal data. 

 

4. Rights of the person concerned

As a data subject, you are entitled to the following data protection rights:

Information: You have the right to request information about the personal data concerning you and stored by BASF SE as well as about the scope of the data processing and data transfer carried out by BASF SE and to receive a copy of your stored personal data.  

Rectification: You have the right to request the immediate correction of inaccurate personal data and the completion of incomplete personal data stored by BASF SE 

Deletion: You have the right to request the immediate deletion or deletion of your personal data stored by BASF SE, provided that the legal requirements are met.

This is particularly the case if:

• your personal data is no longer needed for the purposes for which it was collected;

• The only legal basis for processing this data was your consent, and you have withdrawn that consent;

• you have objected to the processing on the legal grounds arising from your particular situation and we cannot demonstrate that there are overriding legitimate grounds for the processing;

• Your personal data has been processed unlawfully; or

• Your personal data must be deleted in order to comply with legal requirements.

If we have transmitted your data to third parties, we will inform them of the deletion insofar as this is required by law.

Please note that your right to erasure is subject to certain limitations. For example, we may not and/or may not delete data that we still have to keep due to legal retention obligations. In addition, your right to deletion does not extend to data that we need to assert, exercise or defend legal claims, unless there are other reasons for further storage.

Restriction of processing: Under certain conditions, you have the right to request the restriction of processing. The requirements are: 

• The accuracy of your personal data is disputed by you and BASF SE must verify the accuracy of the personal data;

• the processing is unlawful, but you refuse the deletion of the personal data and instead request the restriction of the use of the personal data; 

• BASF SE  no longer needs the personal data for the purposes of processing, but you need the data to assert, exercise or defend your legal claims.

• you have objected to the processing until it is established whether the  legitimate reasons of BASF SE outweigh your legitimate reasons.

If processing has been restricted, this data will be marked accordingly and, with the exception of storage, will only be processed with your consent or for the purpose of asserting, exercising or defending legal claims or protecting the rights of another natural or legal person or for reasons of important public interest of the EU or an EU Member State.

Data portability: Insofar as we process your personal data that you have provided to us on the basis of your consent or a contract with you by automated means, you have the right to receive this data in a structured, common and machine-readable format and to transmit this data to another controller without hindrance from BASF SE. You also have the right to have the personal data transmitted directly from BASF SE to another controller, where technically feasible, provided that this does not adversely affect the rights and freedoms of others. 

Withdrawal of consent: If you have given consent to the processing of your personal data, you can withdraw this consent at any time. Please note that the revocation is only prospective. Processing that took place before the revocation of consent remains unaffected.

Complaint: In addition, you have the right to lodge a complaint with a data protection authority if you believe that the processing of your personal data is unlawful. The right to lodge a complaint is without prejudice to any other administrative or judicial remedies. 

Right to object: You have the right to object to the processing of your personal data for reasons arising from your particular situation. The prerequisite for this is that the data processing is carried out in the public interest or on the basis of a balancing of interests. This also applies to profiling. Insofar as we base the processing of your personal data on a balancing of interests, we generally assume that we can prove compelling reasons worthy of protection, but will of course examine each individual case.  We will stop processing your personal data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or your personal data is used to assert, exercise or defend legal claims.

From time to time, we will update this Privacy Policy.  Any changes will be effective when we post the revised Privacy Policy on the App.  This Privacy Policy was last updated on the "Last Updated" date indicated above.
